Power of Attorney

A power of attorney is a useful document when you are not able to come to Spain to sign the title deeds yourself, but it is more than that.

A power of attorney, also known as POA, makes sure that your solicitor handles the purchase or the sale of your property on your behalf signing all legal paperwork at the notary in your name. A power of attorney is also regularly used with inheritances proceedings; the power of attorney allows the solicitor to represent one or more inheritors when expediting the inheritance.

The most used power of attorney by foreigners is a special (limited) POA for selling and buying, in this document your solicitor will include: operating the bank account, representation in public offices (like the police and tax office) Spanish notary, land registry, make and authorize payments en sign contracts, in the case of a mortgage on the property to purchase, this will be added to the power of attorney.
In the case of an inheritance a special power of attorney for inheritances is made.

A POA in Spain is always signed in a public notary; the notary will make an official document of the power attorney and register it at the national registry for powers of attorney, signing a power of attorney at a Spanish notary needs to be done with a translator present.
In Spain a  power of attorney from the Spanish Consulates and from foreign notaries or solicitors will be accepted also, as long as they are translated into Spanish and stamped with the Apostille.
When your solicitor uses the power of attorney he has to be present it together with his identification.

Important to know is that you always can revoke the power of attorney, this has to be done at any Spanish notary or another option is keeping the original POA signed abroad when it does not give power to make legal copies of itself.
